As far as the toast....hers isn't even in the same medium? That's a crock to claim you ripped off her design. I mean, if she had invented toast, I could see the problem. As far as the tree, offer to compare patterns. If you are close to his design and he holds a copyright, I recommend taking it down. Otherwise, phooey on them. You can't steal something someone doesn't own.

I agree with the previous post. I really think some people are just a little toooo uptight... Number one, it's not like you're mass marketing these things in Walmart or anything... Secondly, just because it's toast that doesn't mean it's the same toast.

Be nice but firm. If these people want to "take you to court" then let them, but I don't see as you've done something wrong here...

Your items are adorable, unique, and your own! Keep up the good work and ignore those who think they know everything. In my humble opinion you have done nothing wrong. You have the right to make whatever you want. You did not use someone elses patterns. Please don't loose sleep over it.

I was under the impression that you couldn't copyright an idea (like "a toy in the shape of bread"), only the actual written pattern; therefore, unless you're copying the pattern itself, you're not violating anything. Think of all of the "celebrity shawl" patterns that are out there, for sale and for free. They're essentially the same thing (because they're all imitations of the same thing), but it's the written instructions that the owners have a copyright on.

While these crafters might like to think they're the only ones with a right to sell x, y, or z, I really don't think it's possible to have a monopoly on the stuffed bread market. Your amigurumi are so creative; keep up the great work!

I definately agree with everyone else. The thing that makes me mad about crochet is that it's easy to apparently copy someones design with out ever being aware of it. Some of the things we make are so basic, you know they've been done before. The thing that scares me about selling anything is that even if something is my own idea and I freehand the item, chances are that someone out there has already copyrighted a pattern for the same thing. It's a messed up thing. But as for your issue, you've done nothing wrong. Just because your item resembles one of theirs does not put you at fault. Unless your pattern is stitch for stitch the same as theirs, it's not the same (in my eyes). Look how many beanie patterns are out there, and they're all basically the same. You don't see a "war of the beanies" or discloths. If it's done in a different medium, than that's just absurd. I would try your best to ignore these people. What can they really do, they have no recourse, I wouldn't think. Good luck and sorry for my frustrated ramblings.

P.S. I adore the tampon!

I say keep them up. You created your own version of common, every day items. There are only so many ways for bread, trees and tampons to look, yk? Maybe you got the idea of making a crochet tampon after seeing someone's felt tampon, but obviously that person got the idea of making a felt tampon after seeing a real tampon....so should they stop selling theirs too?

I do feel maintaining the integrety of copyright is very important, but at some point there are going to be overlapping ideas and creations. As long as you did come up with the stitch sequences on your own I feel you are in the clear to claim your items are yours.

What a crock....I think if you buy the yarn, and crocheted it, it's yours. Next thing you know people will be at Goodwill yelling about selling name brand seconds....:eek :lol :lol :lol

Your tampon is really different? What in the world would you want to crochet a tampon for? :D I hated having periods and am very glad I don't have to worry about carrying around Mr Tampon with me anymore....hahahahahaa Your quite a creative person.
Keep it up! It is really cute though...

Hi, I go to read my messages and yarnmistresses are *'s...

I have seen toast before, but not in the same concept as hers on etsy... I have seen a whole crochet food setup on a website too...But I haven't seen it as eyes on it and etc...

I have many designs and some that didn't get posted as I felt that when I did get them up someone had something too similar to it...

But don't leave the group because someone thinks that the pattern is too similar, they have to prove you have taken it word for word and exactly like they have which is doubtful.

well I hope she keeps designing,

Thanks Bren. Just so you know, it wasn't anyone here on this board that was telling me I should stop selling the items I have on my store. It was members of another board (which I have decided not to go to anymore).

That isn't a nice board to be at if they pick apart patterns and say they are someone elses...

I had an ear cuff pattern but since P2 and a nice lady here have them, I have not posted mine, not original enough anymore..is one that is sitting in my design bin..

well off to get dinner finished and get a 6-12 month baby hat and booties done tonight watching tv...
